Terms and Conditions of Sale

Welcome to Joll Christmas. These Terms form a binding agreement between you and Griselda Jolley, doing business as JOLL CHRISTMAS, the operator of jollchristmas.com, and apply to all visits and purchases. Our Return and Refund Policy, Shipping Policy and Privacy Policy are part of these Terms. Your use of the Site or completion of an order constitutes acceptance.

The Seller

The Site is operated by Griselda Jolley, doing business as JOLL CHRISTMAS, a limited liability company engaged in online retail of Christmas decorations and seasonal home decor (EIN 43-2471462). Who May Use the Site

Purchases may only be made by persons aged 18 or over who can lawfully enter into contracts. This Site is not intended for children under the age of 13, in line with the Children's Online Privacy Protection Act, and we do not knowingly collect their data. When you place an order you confirm that the information you provide is accurate and that you are authorized to use the chosen payment method.

Payment Methods and Billing

Accepted payment methods: Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, Google Pay and Shop Pay. All transactions are handled by Shopify Payments (powered by Stripe) using industry-standard encryption; card details never touch our systems. Charges are made at the time of order and show on your card statement as JOLLCHRISTMAS.COM. Orders may be held for verification when the billing and shipping details do not match or our provider detects unusual activity; we will contact you if we need anything. For any billing question, write to help@jollchristmas.com and we will look into it right away.

Shipping

Delivery is available to the United States. Processing takes 1–2 business days, then 10–15 business days with Standard Shipping (USD 8.90; free from USD 149) or 8–11 business days with Fast Shipping (USD 27.94). Tracking is provided for every shipment. Should a shipment be delayed beyond the promised date, we tell you in advance and you may cancel free of charge for a full refund, as required by the FTC Mail, Internet, or Telephone Order Merchandise Rule. Returns and Cancellation

Our cancellation and refund terms, in summary: cancel at no cost before the order ships; return eligible items within 90 days of delivery, unused and in original packaging, to 1904 East Sandalwood Ave, Tulare, CA 93274, United States; return postage is free; refunds go back to the original payment method 5–10 business days after we receive and inspect the item (7 business days for cancellations); faulty or wrong items are always replaced or refunded free of charge. The full Return and Refund Policy, which you accept at checkout, governs in case of any difference.

Placing an Order

Your order is an offer to buy. After checkout you receive an order confirmation email; this acknowledges receipt of your order but does not accept it. A contract of sale is formed when we ship the goods and send the shipping confirmation. We may decline or cancel an order before shipment for reasons including unavailability, a pricing or description error, suspected fraud, or a shipping address we cannot serve; if we do, any payment is refunded in full within 7 business days. We may limit quantities per order or per customer.

Pricing

Prices are quoted in USD and can change without notice, but the price you see when you order is the price you pay. Applicable taxes (calculated at checkout based on the shipping address) and any shipping charge appear at checkout before payment, so the final total is always visible before you commit. Promotional "was" prices are genuine prior prices. Should an obvious pricing mistake occur, we are not obliged to sell at the wrong price: we will tell you and let you decide whether to proceed.

Site Rules

Use the Site lawfully and in good faith: no fraudulent or unauthorized orders, no attempts to breach security, no automated scraping, no abuse of discounts. Reviews on our product pages come from customers who bought the product; we take reasonable steps to verify them and never commission fake reviews. Content you submit must be truthful and yours; you allow us to publish it and we may remove anything inappropriate.

Our Liability

Our responsibility to you for any order is capped at the price you paid for it, and we are not responsible for indirect or consequential losses — such as lost profits or lost data — to the extent the law lets us exclude them. Nothing in these Terms limits liability for personal injury or death caused by our negligence, for fraud or fraudulent misrepresentation, or any liability that consumer protection law does not allow us to limit. Where your state or country does not permit some of these exclusions, they apply to you only as far as the law allows.

Content Ownership

The Site and everything on it, including the Joll Christmas name and logo, images, copy and design, belong to us or our licensors. You receive a limited, revocable license to use the Site to shop; no other rights are granted. Copying our content for commercial use, scraping the Site or reusing our images requires our written consent. Notices of alleged infringement should be sent to help@jollchristmas.com.

Limited Warranty and Disclaimer

We provide the limited warranty set out in our Return and Refund Policy. Except for that warranty, and to the fullest extent the law allows, we make no other express warranties, and implied warranties of merchantability and fitness for a particular purpose are limited to the duration of the limited warranty. Some states do not allow such limitations, so they may not apply to you; this warranty gives you specific legal rights and you may have others that vary by state. Consistent with the Magnuson-Moss Warranty Act, nothing in these Terms disclaims implied warranties while a written warranty is in effect.

Descriptions and Images

We make every effort to describe products accurately and to show them as they are. Colors may vary slightly with your screen settings, and dimensions are approximate unless stated as exact. Our products are unbranded, generic items sourced from selected manufacturers; any brand names appearing in descriptions are for compatibility reference only and do not indicate affiliation. Product availability is not guaranteed until an order ships; if an item becomes unavailable we contact you with the options of waiting, a substitute or a full refund. We do not use false scarcity or countdown claims.

Governing Law and Dispute Resolution

The law of California, including the California Unfair Competition Law, Bus. & Prof. Code § 17200 et seq., and Consumers Legal Remedies Act, Civ. Code § 1750 et seq., and U.S. federal law govern these Terms. We ask that you raise any problem with us first — write to help@jollchristmas.com and give us 30 days to put it right. If that fails, you and Joll Christmas agree to resolve the dispute through binding arbitration on an individual basis before the American Arbitration Association (AAA) under its consumer arbitration rules (the Federal Arbitration Act applies), or in small claims court if the claim qualifies. Both parties waive the right to a jury trial and to participate in class or representative actions. You can reject this arbitration clause by notifying us in writing within 30 days after your first order; the rest of the Terms will still apply. You always retain the right to complain to your state attorney general or the FTC.

Changes, Severability and Entire Agreement

These Terms can change; check the date at the bottom of this page, and remember that each order is governed by the Terms published when it was placed. Should a court hold any clause invalid, the other clauses remain binding. Not enforcing a right today does not mean we give it up. Together with our Return and Refund, Shipping and Privacy Policies, these Terms are the complete agreement between us, replacing any earlier terms. Rights under these Terms are personal to you and not transferable; we may transfer ours if the business is sold.
